FENCING – TERMS AND CONDITIONS

The following terms and conditions do not affect your statutory consumer rights.

DEFINITIONS

Within these terms and conditions, the following terms will be referred to:
Customer means the person or company purchasing the product

1. GENERAL

1.1 These terms and conditions are applicable to the supply of products by the seller, hereby referred to as Amberley Products, to the buyer hereafter referred to as the customer.

1.2 The documents and related graphics published on this website could include inaccuracies or typographical errors. Changes are periodically added to the information herein. Amberley Products may make improvements and/or changes in the product(s) described herein at any time.


2. PRICES

2.1 Prices are in pounds sterling (£). 

2.2 All prices are inclusive of VAT and exclusive of carriage charges unless otherwise stated.

2.3 Our standard delivery charge of £8.00 per order only covers orders for delivery to mainland England and Wales .. Most other areas can be quoted for separately on request.


3. PAYMENT

3.1 Payments are to be made in pounds sterling (£) by acceptable credit card, debit card or cheque. Cheques should be made payable to Amberley Products.

3.2 The goods shall remain the property of Amberley Products until full payment has been made by the customer and it has been received by Amberley Products.

4. PASSING OF RISK

4.1 The risk in the goods shall pass to the Customer on delivery, as defined in clause 5.4 below


5. DELIVERY

5.1 It is our policy to process and despatch orders held from our stocks as soon as possible within 7 days of receipt of order unless otherwise advised. Amberley Products cannot be held responsible for any delays caused by the manufacturer, courier or any other third party.

5.2 Our standard delivery charge is £8.00 per order. (See 2.3 above)

5.3 Orders are either delivered by ourselves, direct from the manufacturer or by courier on a pallet service. We deliver only to addresses in England and Wales and someone will be required to assist the driver with offloading the pallet.

5.4 The customer bears the risk once the goods have been delivered and signed for.


6. ACCEPTANCE

6.1 The customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 7 (seven) days after their receipt we have been notified that the goods have been rejected. If no such action has been taken, Amberley Products will consider the products are acceptable and may not accept any return at a later date. 

6.2 Amberley Products may at their discretion accept a return but only on the following basis:

6.2.1 The goods are undamaged and in a re-saleable condition

6.2.2 An administration charge of 10% is payable

6.2.3You must have a returns number. This can only be obtained by e-mail or letter as we do not accept telephone calls for returns.


7. RETURNS PROCEDURE

7.1 The customer must return the goods and clearly quote the returns number on the package.

7.2 The goods must be returned within 7 (seven) days to the following address:

7.3 Goods returned without a returns number cannot be actioned.

7.4 It is your responsibility to arrange and pay for the return of the goods. (Please note – the amount you are charged for a returned delivery may be significantly higher than what we originally charged you as we subsidise the actual cost of delivery).

7.5 In cases where the rejection of the goods is due to a defect or discrepancy with the order, the customer is entitled to a full refund or replacement. These must be returned to Amberley Products before a refund or replacement can be issued.


8. CANCELLATIONS

8.1 Cancellations are only accepted if the customer complies with the following cancellation procedure and before the order has been despatched.

8.2 Cancellations can be made with Amberley Products by e-mail (sales@amberleyproducts.co.uk) or letter to Amberley Products.

8.3 Amberley Products will then confirm the cancellation of the order

8.4 Unless cancellation is made within 7 days from the date of order, a cancellation charge of 10% of the total order value will be levied.


9. LICENSE AGREEMENT

9.1 The customer shall respect all licence agreements delivered by the copyright / trademark owners. Amberley Products cannot be held responsible or liable for any misuses conducted by the customer or any third party.

10. LAW

10.1 These terms and conditions are governed by and shall be interpreted in accordance with the laws of England and Wales.
